Rochester, MN (KROC-AM News) - A Rochester man has been charged with threatening another man with a loaded military-style rifle.

According to a criminal complaint filed in Olmsted County Court, a Rochester Police Officer was dispatched to a home in southeast Rochester around 3 AM on June 19 to investigate a report of an assault. The officer met with a man who reported that he had been followed home by another vehicle and a man from the other car pointed what appeared to be an AK-47-type rifle at him.

The victim, who was with his 7-year-old daughter, indicated the incident occurred shortly after he parked in his driveway and the car that was following him stopped in the road in front of his home. He also told the officer that he recognized the man with the gun and identified him as 26-year-old Jorge Lozano.

The court document says the victim told the officer he was scared for his life and the life of his daughter, who had witnessed the incident. When the child was interviewed, she stated that she saw people get out of the car and one had a big gun. Her father also alleged that Lozano told him not to call the cops because "you know what will happen."

The criminal complaint charges Lozano with one count of second-degree assault with a dangerous weapon. It says Lozano was arrested on July 25th during a traffic stop on Highway 52. The court document says Lozano was in the passenger seat and the officer involved in the traffic stop spotted a rifle at his feet. The weapon was seized and was described as an assault rifle chambered with a 7.62 mm bullet.

At last check, Lozano was being held in the Olmsted County Jail with his conditional bail set at $20,000. He is due back in court on August 4th.
